What is murder?

Murder is an unlawful killing of someone. Most cases in murder, the perpetuator intents to kill with malice. The first few elements are relatively straightforward; however, the concept of "malice aforethought" is a complex one that does not necessarily mean premeditation. The following states of mind are recognized as constituting the various forms of "malice aforethought":

  • Reckless indifference to an unjustifiably high risk to human life, or
  • Intent to commit a dangerous felony.

  • The element of malice aforethought can be satisfied by an intentional killing, which is considered express malice.

  • Murder committed in the perpetration or attempted perpetration of sexual assault, arson, robbery, and burglary, invasion of the home, and sexual abuse of a child, sexual molestation of a child under the age of 14 years or child abuse.
  • Murder committed to avoid or prevent the lawful arrest of any person by a peace officer or to affect the escape of any person from legal custody.
  • Murder committed on the property of a public or private school, at an activity sponsored by a public or private school or on a school bus while the bus was engaged in its official duties by a person who intended to create a great risk of death or substantial bodily harm to more than one person by means of a weapon, device or course of action that would normally be hazardous to the lives of more than one person.
  • Murder committed in the perpetration or attempted perpetration of an act of terrorism.

According to Nevada State Law: NRS 200.010“Murder” defined.Murder is the unlawful killing of a human being:

  • With malice aforethought either expresses or implied;
  • Caused by a controlled substance which was sold, given, traded or otherwise made available to a person in violation of chapter 453 of NRS; or
  • Caused by a violation of NRS 453.3325.
