What is Manslaughter?

Manslaughter is the unlawful killing of human, it is considered by law as less culpable than murder. The law differentiates the level of culpability based on the state of mind of a person whom is accused of manslaughter or also known as homicide.

In cases of mutual combat, it is generally manslaughter only when one of the parties is killed. When death ensues from dueling the rule is different, and such killing is murder.

Manslaughter is divided in two parts:

  • Voluntary Manslaughter: It occurs when a defendant kills with malice. But there are mitigating circumstances which reduce culpability. Voluntary manslaughter is a lesser included offense of murder. The traditional mitigating factor was provocation (a common law defense to murder).
  • Involuntary Manslaughter: It occurs when a person accidentally kills someone without malice or without the intent to kill. It is distinguished from voluntary manslaughter by the absence of intention.

When death ensues from the performance of a lawful act, it may, in consequence of the negligence of the offender, amount to manslaughter. For instance, death occurs by a negligent driving. Most common act of manslaughter is vehicular accidents. If you get in your car and have an accident and the other driver dies, that's vehicular manslaughter. If you get in your car and see someone you hate and you use your car to intentionally run them down, that's murder.

Additional penalty for violation committed in work zone; notification to Department of conviction by court; recordation of conviction upon driving record of violator. On conviction for manslaughter, sentencing is at the judge's discretion, whereas a sentence of life imprisonment is mandatory on conviction for murder.
