Sealing Records Attorney

What is sealing record? It is an act to seal or lock some important documents regarding an investigation on court. Such as destroying court records that would otherwise accessible for public records. The public policy of record sealing balances the desire to free named citizens from the burdens caused by the information contained in state records while maintaining the state's interest in the preservation of records that may be beneficial to the state or other citizens.

Records are commonly sealed in a number of situations:

  • Sealed birth records.
  • Juvenile criminal records may be sealed.
  • Other types of cases involving juveniles may be sealed e.g., child sex offense or custody cases.
  • Cases using witness protection information may be partly sealed.
  • Cases involving trade secrets.
  • Cases involving state secrets.

Sealing Criminal Record:There are different ways to seal criminal records, using three different laws. The first law lets you seal some convictions after a waiting period. The second law lets you seal some cases where there was no conviction (like dismissed cases, not guilty findings, and others). The third law lets you seal some misdemeanor drug possession cases.

Court proceedings are a matter of public record. However, the court has the power to seal court records. Some records are automatically deemed confidential such as doctor and patient correspondence, sessions with a licensed mental health professional, sexual assault victims and juvenile records. If information disclosed during a trial is harmful to the plaintiff or defendant, file a motion to seal the court record.

Sealing a record in Nevada? According to NRS 179.245Sealingrecords after conviction:

Persons are eligible for petition, notice, hearing and order.

Except as otherwise provided in subsection 5 and NRS 176A.265, 176A.295, 179.259, 453.3365 and 458.330; a person may petition the court in which the person was convicted for the sealing of all records relating to a conviction of:

  • A category A or B felony after 15 years from the date of release from actual custody or discharge from parole or probation, which ever occurs later;
  • A category C or D felony after 12 years from the date of release from actual custody or discharge from parole or probation, which ever occurs later;
  • A category E felony after 7 years from the date of release from actual custody or discharge from parole or probation, whichever occurs later;
  • Any gross misdemeanor after 7 years from the date of release from actual custody or discharge from probation, which ever occurs later;
  • A violation of NRS 484C.110 or 484C.120 other than a felony, or a battery which constitutes domestic violence pursuant to NRS 33.018 other than a felony, after 7 years from the date of release from actual custody or from the date when the person is no longer under a suspended sentence, which ever occurs later; or
  • Any other misdemeanor after 2 years from the date of release from actual custody or from the date when the person is no longer under a suspended sentence, which ever occurs later.
