Manslaughter Attorney

What is Manslaughter? Manslaughter is the unlawful killing of human, it is considered by law as less culpable than murder. The law differentiates the level of culpability based on the state of mind of a person whom is accused of manslaughter or also known as homicide.

The common act of manslaughter is self-defense. If someone tries to kill you, what will you do? Of course, you defend yourself. But upon defending yourself; you accidentally kill that someone. Now, that act is called Homicide. If a person intents to kill someone with a state of mind of malice, then he or she can be accusing of murder.

The cases of manslaughter may be classed as follows those which take place in consequence of:

  • Provocation
  • Mutual combat
  • Resistance to public officers, etc.
  • Killing in the prosecution of an unlawful act
  • Killing in the prosecution of a lawful act, improperly performed, or performed without lawful authority.

The provocation which reduces the killing from murder to manslaughter is an answer to the presumption of malice which the law raises in every case of homicide; it is therefore no answer when express malice is proved and to be available the provocation must have been reasonable and recent, for no words or slight provocation will be sufficient, and if the party has had time to cool, malice will be inferred. In cases of mutual combat, it is generally manslaughter only when one of the parties is killed. When death ensues from dueling the rule is different, and such killing is murder.

Manslaughter is divided in two parts:

  • Voluntary Manslaughter It occurs when a defendant kills with malice. But there are mitigating circumstances which reduce culpability. Voluntary manslaughter is a lesser included offense of murder. The traditional mitigating factor was provocation (a common law defense to murder).
  • Involuntary Manslaughter It occurs when a person accidentally kills someone without malice or without the intent to kill. It is distinguished from voluntary manslaughter by the absence of intention.

When death ensues from the performance of a lawful act, it may, in consequence of the negligence of the offender, amount to manslaughter. For instance, death occurs by a negligent driving. Again, when death ensues, from the gross negligence of a medical or surgical practitioner, the practitioner is liable of manslaughter.

Most common act of manslaughter is vehicular accidents. If you get in your car and have an accident and the other driver dies, that's vehicular manslaughter.
If you get in your car and see someone you hate and you use your car to intentionally run them down, that's murder.

Penalties according to NRS 484.3775 Vehicular manslaughter: Additional penalty for violation committed in work zone; notification to Department of conviction by court; recordation of conviction upon driving record of violator. On conviction for manslaughter, sentencing is at the judge's discretion, whereas a sentence of life imprisonment is mandatory on conviction for murder.
