Shoplifting

Have You Been Arrested for Shoplifting?

Shoplifting is a misdemeanor criminal charge if the item or property stolen is valued at less than $250.00. However, if the value of the property which was taken is more than $250.00 the crime is more serious and can be charged as a felony. If you or someone you care about has been charged with a petty larceny or shoplifting or even questioned by the police, the stakes are high. The consequences of a criminal conviction can include up to six months in jail and a possible fine of up to $1,000.00

An experienced criminal defense attorney can often negotiate to have the shoplifting charge dismissed, or reduced if it is charged as a Felony.

The following Nevada Shoplifting Statutes detail the potential consequences associated with a conviction for shoplifting.

NRS 205.240 Petit larceny; Penalty.

1. A person commits petit larceny if the person:

(a) Intentionally steals, takes and carries away, leads away or drives away: (1) Personal goods or property, with a value of less than $250, owned by another person;

If you have been arrested for shoplifting, it’s important that you don't delay in speaking with an experienced criminal defense lawyer. Often, law enforcement will want you to make a statement, or provide them with information. However, this is almost never a good idea to do without first consulting with an experienced criminal defense lawyer.

Preparing your Defense

Although you may have been arrested, or even charged with shoplifting, there is still hope. A shoplifting charge does not equal a conviction, and there are many steps a criminal defense attorney can take to ensure that your rights are protected. An experienced attorney may be able to determine if there are constitutional issues related to the search of the defendant's home, vehicle, or person, and a motion to suppress evidence may be appropriate.
