LAS VEGAS BAD CHECK ATTORNEY

Bounced checks happen to most people from time to time, especially in an era of constant ATM withdrawals and paying for purchases with debit cards which deduct money directly from your checking account. Issuing a bad check is punishable by law. In most cases, if you accidentally give a bounce check, you normally contact the payee when you notice your error. But what if the payee initiates legal actions? What will happen? Will you be able to be in restitution? Or will you be jailed for your error? Unfortunately, you can not predict what will happen, as it depends on so many variables, including the state in which the event occurred.

If you have been arrested for writing/issuing a bad check in Las Vegas,it's very important that you hire an experienced Las Vegas Criminal Defense Attorney to represent you. If you or someone you care about has been charged with writing/issuing a bad check or even questioned by the police, the stakes are high. The consequences for a criminal conviction can include possible jail or prison time, fines, and/or restitution. Our advice is simple; you must hire a good Las Vegas criminal defense lawyer. Attorney William A. Kennedy caters counseling regarding bad checks.

The following Nevada Statutes detail the potential consequences associated with a conviction for writing a bad check:

NRS 205.130 Issuance of check or draft w/o sufficient money or credit: Penalties.

  • A person who willfully, with intent to defraud, draws or passes a check or draft to obtain:
  1.  Money
  2.  Delivery of other valuable property
  3.  Services
  4.  The use of property
  5.  Credit extended by any licensed gaming establishment, drawn upon any real or fictitious person, bank, firm, partnership, corporation or depositary, when the person has insufficient money, property or credit with the drawer of the instrument to pay it in full upon its presentation, is guilty of a misdemeanor. If that instrument, or a series of instruments passed in the State during a period of 90 days, is in the amount of $250 or more, the person is guilty of a category D felony.

If you have been arrested for writing/issuing a bad check it's important that you don't delay in speaking with an experienced criminal defense lawyer. Often, law enforcement will want you to make a statement, or provide them with information. However, this is almost never a good idea to do without first consulting with an experienced criminal defense lawyer.
