LAS VEGAS ASSAULT LAWYER

In Las Vegas, a conviction for misdemeanor assault can result in jail sentence of up to one year, and a fine amount of up to $1,000.00. Typically, assault charges are brought when a threat is made, and a victim is placed in reasonable apprehension of immediate bodily harm, absent actual physical contact.

The following Nevada Assault Statute details the potential consequences associated with a conviction for Assault:

NRS 200.471 Assault: Definitions; Penalties.

(a) “Assault” means intentionally placing another person in reasonable apprehension of immediate bodily harm. A person commits the offence strictly known as assault or common assault if he intentionally or recklessly causes another person to apprehend immediate and unlawful personal violence. Simple assault can be distinguished without the intent of injury upon another person. Simple assault can consist simply of the violation of one's personal space or touching in a way the victim deemed inappropriate.

(b) If the assault is made with the use of a deadly weapon, or the present ability to use a deadly weapon, for a category B felony by imprisonment in the state prison for a minimum term of not less than 1 year and a maximum term of not more than 6 years, or by a fine of not more than $5,000, or by both fine and imprisonment.

American common law has defined assault as an attempt to commit a battery. Four elements were required at common law:

  1. The apparent, present ability to carry out;
  2. An unlawful attempt;
  3. To commit a violent injury;
  4. Upon another.

Some states also define assault as an attempt to menace by placing another person in fear of imminent serious bodily injury. There are lots of types of assault that can harm anybody.If you have been arrested on an assault charge, it's important that you don't delay in speaking with an experienced criminal defense lawyer.
