Filing A Lawsuit
There are various reasons why you might be interested in filing a lawsuit. Maybe someone owes you money, or you’ve been injured and you believe that someone else is responsible for your injuries, or maybe you’re involved in a dispute with a business partner. Regardless of the reason, Civil Court is the proper forum for initiating an action (lawsuit) and seeking monetary damages.
In Clark County, the Court where you will initiate your lawsuit depends upon the amount of damages that you are seeking. For instance, if you are seeking damages up to $5,000.00 you have the option of initiating your case in Small Claims Court. Although lawyers may appear in Small Claims Court in Las Vegas it is generally not necessary to have an attorney.
An Alternative to Small Claims Court in Las Vegas is Justice Court. Justice Court in Las Vegas handles both Criminal (through the preliminary hearing stage of a Felony case), as well as Civil matters, and the presiding Judge is an elected Justice of the Peace. Las Vegas Justice Court addresses civil cases where the amount in controversy is up to $10,000.00.
For cases where the damage award may exceed $10,000.00 the proper forum is Clark County District Court. The District Court is also the proper forum for cases where extraordinary relief is sought; ie, injunctions, specific performance, etc. The District Court also handles all criminal cases involving gross misdemeanors and Felonies after the preliminary hearing stage.
